DESCRIPTION
This project will take an in-depth look at Latin American and European bankruptcy legislation, so important for the basic economy and for transnational business ventures, with attention to both the shortcomings of the two systems and their potential for harmonisation. The results will be used in two sets of proposals aimed at: (i) the improvement of national systems and (ii) the identification of cross-boarder formulas for resolving situations of insolvency. Among the main issues addressed will be the criteria defining the state of insolvency; the discretionary application of procedures; identification of the bankruptcy estate; restructuring of the bankruptcy estate; public creditors; mortgages and other tangible collateral; cross-border receivables and payables; company restructuring and winding-up.
