DESCRIPTION
The effective free movement of capital and freedom of establishment which are essential requisites for a unified mortgage market are being held back, in this case, by the difficulties of choosing a mortgage standard (which has to fit in with different European legal systems while serving the interest of the international market).
The required steps, as such, are to make a comparative study of legal provisions, to analyse the current status of the mortgage loan in Europe, to ascertain the need for and viability of a European mortgage and to draft a ‘euromortgage’ law or directive based on an effective legal or economic standard.
The methodology adopted is that of a historical comparative study, in this case between the different mortgage variants existing under Europe’s diverse legal systems. By this means, a model can be put forward for discussion on the advantages and drawbacks of writing it into a draft law.
